What type of data do we process? And for what purposes?
 
If we have received data from you, in principle we will only process this data for the purposes for which we have received or collected it.

Data processing for other purposes only comes into consideration insofar as there are essential legal requirements according to art. 6 para. 4 GDPR.

In this case, we will adhere to any obligations to supply information according to art. 13 para. 3 GDPR and art. 14 para. 4 GDPR as a matter of course.


Which legal foundation is the basis for this?
 
The legal foundation for the processing of personal data is as a basic principle -provided there are no other specific legal provisions - art. 6 GDPR.
The following options are to be taken into account in particular:
  • Consent (art. 6 para. 1 lit. a) GDPR)
  • Data processing to fulfil contracts (art. 6 para. 1 lit. b) GDPR)
  • Data processing based on balancing interests (art. 6 para. 1 lit. f) GDPR)
  • Data processing for compliance with a legal obligation (art. 6 para. 1 lit. c) GDPR)

If personal data are processed based on your consent, you have the right to revoke this consent at any time with future effect.

If personal data are processed based on balancing interests, you - as the person concerned - have the right to object to the processing of personal data, under consideration of the provisions of art. 21 GDPR.
 
For how long are data saved?
 
We process data as long as they are required for the specific purpose.

If there are legal obligations to retain records - e.g. for commercial law or fiscal law - the personal data concerned are saved for the period of time of the obligation to retain records. At the end of the obligation to retain records it is ascertained whether there is a still a requirement for processing. If there is no longer a requirement, the data are deleted.
In general, we make a check of data at the end of a calendar year with regard to the requirement for further processing. Based on the amount of data, this check is carried out with regard to specific types of data or processing purposes.

You may of course request information about your personal data saved by us at any time (see below). In the event that the saved data is no longer required, you can request deletion of the data or restriction of processing.


Who are the recipients of the transmitted data?

Transmission of personal data to a third party only takes place if one of the following applies: it is required to perform your contract, transmission is permitted based on balancing of interests, according to art. 6 para. 1 lit. f) GDPR, we are legally obliged to transmit the data, or you have given your consent.

Where are the data processed?
 
Your personal data are exclusively processed in data processing centres in the Federal Republic of Germany.
 
Your rights as the "person concerned"
 
You have the right to obtain information on your personal data that is processed by us.

If an information request is not submitted in written form, we ask for your understanding in that we may have to request evidence to prove that you are the person in question.

Furthermore, you are entitled to correction, deletion or restriction of processing, insofar as this is your legal right.

In addition, you have a right of objection to processing in the context of the legal provisions. There is also a right to data portability under the provisions of data protection law.

You have a right of objection according to art. 21 para. 1 and 2 GDPR in particular, with regard to the processing of your data in the context of direct advertising, if this is based on the balancing of interests.
